Terms of Use

1. License Grant

• Anyone — individuals, companies, institutions and for-profit users alike — may use every feature of the Software free of charge.
• The only difference between the free edition and a licensed copy is the watermark shown on exported photos and slideshows. To use the Software without the watermark, purchase and register a license.
• The registration and use conditions of a license follow the terms given at purchase. For questions, use the contact above.

2. Restrictions

The following are not permitted without prior written permission.

• Reselling, redistributing, leasing or renting the Software itself
• Reverse engineering, decompiling or disassembling (except where such acts are guaranteed by law)
• Removing or altering copyright notices or these terms

However, modifying the LGPL components listed in Article 5 (Qt, LibRaw, the FFmpeg libraries of Qt Multimedia, etc.) or replacing them with another interface-compatible build, and reverse engineering to the extent needed to debug such modifications, are permitted under those licenses (GNU LGPL).

3. Ownership

Copyright and intellectual property rights in the Software and all of its components (except the third-party components in Article 5 below) belong to the copyright holder. These terms grant a right of use only and do not transfer ownership.

4. No Warranty / Limitation of Liability

The Software is provided "AS IS", without warranty of any kind, express or implied. The copyright holder shall not be liable for any direct, indirect or incidental damages (including data loss) arising from the use of, or inability to use, the Software. You are responsible for keeping separate backups of important files.

5. Third-Party Components

For video processing, the Software (Qt edition) includes and invokes FFmpeg (ffmpeg.exe, ffprobe.exe) as separate executables (child processes). FFmpeg is not linked into the Software and is distributed unmodified.

• FFmpeg is distributed under the GNU GPL v3 license and is copyright of the FFmpeg developers.

For the user interface and video playback the Software links the Qt 6 libraries, and for camera RAW decoding the LibRaw library, DYNAMICALLY (as DLLs). Neither library is modified, and you may replace them with your own interface-compatible builds.

• Qt 6 is distributed under the GNU LGPL v3 license and is copyright of The Qt Company and contributors. The Software uses no GPL-only Qt module.
• LibRaw is distributed under a dual LGPL v2.1 or CDDL v1.0 license and is copyright of the LibRaw authors.
• The FFmpeg libraries shipped with Qt Multimedia (avcodec and friends) are a different, LGPL v2.1 build from the executables above.

The Software also links libtiff, libjpeg-turbo, libwebp, zlib, xz (liblzma), JasPer and Little-CMS dynamically.

6. Data and Privacy

• The Software stores your content — photos, videos, the index, edits and so on — only locally on your PC and does not transmit its contents anywhere. AI adjustments are also processed on your PC.
• The Software scans the drives connected to this PC to find photos and videos. Files are only read; they are never moved, modified or deleted except when you explicitly ask (rename, move, send to the Recycle Bin, paste, applying a video rotation). Edits are stored separately and never change the original file. System and program folders are excluded by default, and you may turn off any drive or exclude any folder at any time in Settings.
• If you allow it, the background indexer (photokam-agent) starts automatically at logon and may keep running after you close the main application. This can be turned off at any time in Settings.
• To improve the product and understand usage, the following anonymous usage data may be transmitted: an anonymous installation number; install, update, launch and exit records with session length; app version; operating system and its version; CPU type (x64 or ARM); language and region; and whether the copy is licensed. It does not identify individuals and never transmits photos, files or paths. You can turn it off at any time with "Send anonymous usage statistics" in Settings.

7. Changes to These Terms

The copyright holder may change these terms in future versions; the changed terms apply from that version onward.

8. Language

These terms are provided in 한국어 (Korean), English, 日本語, Français, Deutsch and Español, set out in that order in a single file. The translations are provided for convenience only; the Korean version is the original. In the event of any difference in meaning or interpretation, or any dispute, between a translation and the Korean version, the Korean version shall prevail.
